 Landowners may apply for free antlerless licenses

PIERRE, S.D. – A law passed by the 2010 Legislature allows many South Dakota landowners to apply for and receive free antlerless deer licenses.

The Game, Fish and Parks Department is offering up to two antlerless deer licenses per qualifying household in West River Deer and East River Deer units that have unsold licenses after the second drawing for each season is completed.

All West River Deer units except Shannon County had licenses remaining after the second drawing and now have the free antlerless deer license option available. The second drawing for East River Deer will be completed by Oct. 15. Units with unsold deer licenses remaining at that time will also have the free antlerless license available.

South Dakota residents who own and operate, or lease and operate for agricultural purposes a minimum of 160 acres of land qualify for the new license option. A maximum of two licenses may be issued per household, and may be issued to the same person or to two family members (spouse, children living at home, or children living on land owned and operated by the resident farmer or rancher). The license is only valid on the qualifying land.

Landowners who were unsuccessful in the regular drawing for licenses, or who did not apply in the regular drawing, also have the option of purchasing a reduced-price license for hunting deer on their own land only.

 Game and Fish Agencies Increase CWD Surveillance Efforts

The South Dakota Game, Fish and Parks Department, North Dakota Game and Fish Department, and the Standing Rock Sioux Tribe Game and Fish are coordinating efforts to increase surveillance in an area where a mule deer in southwestern North Dakota tested positive for Chronic Wasting Disease (CWD).

All three agencies will sample deer, elk, and moose that have been taken by hunters, killed on roads, or appear to be sick. 

The increased surveillance area includes North Dakota deer hunting unit 3F2 (eastern Adams County, southeastern Hettinger County, southern Grant County, south central Morton County and all of Sioux County), the Standing Rock Reservation, and South Dakota deer units 53A (northern Perkins County) and 20A (Corson County).

Most samples will be taken during each agency’s deer rifle season in November. Additional details about collection points will be distributed prior to those deer rifle seasons.  South Dakota hunters will be receiving letters in the mail with instructions on how to submit samples. 

North Dakota Game and Fish Department officials were notified in March that a sick mule deer taken last fall in western Sioux County tested positive for CWD, the first time an animal has tested positive in North Dakota.

This deer was found near the South Dakota border, concerning South Dakota officials, too. South Dakota Game, Fish, and Parks has a surveillance program that will sample sick deer in any area when they are reported. This is the first CWD deer found near that area of the state.

South Dakota has been testing for CWD through statewide surveillance of sickly deer and elk. However, that effort has focused in the southwestern part of the state where the disease is established.  CWD has been found in the Black Hills and Custer and Fall River Counties of South Dakota.

In addition to targeted surveillance, the North Dakota Game and Fish Department has sampled that entire state twice by annually collecting samples taken from hunter harvested deer in specific regions of the state. Samples have also been collected by the Standing Rock Sioux Tribe Game and Fish Department during its hunting seasons. 

CWD affects the nervous systems of members of the deer family and is always fatal. Scientists have found no evidence that CWD can be transmitted naturally to humans or livestock.

Outdoor Expo site of GFP Antler Auction

 
PIERRE, S.D. – A change in state law has paved the way for the Game, Fish and Parks Department to auction items that have been confiscated in recent years as part of the agency’s conservation law enforcement work efforts.
 
“The 2009 South Dakota legislature passed a law that allows our agency to offer for sale items we have seized through law enforcement activities,” Andy Alban, Law Enforcement Program Administrator for the GFP Division of Wildlife said. “In the past, if the GFP would have sold anything like antlers, hides or skulls, the buyer would not have been allowed, by law, to resell them.  The law now gives full ownership to anyone buying these items.  The law also stipulates that we sell these items in a manner that brings a competitive price. We feel that offering them through auction will meet those requirements.”
 
The auction will take place as part of the 3rd Annual South Dakota Outdoor Expo on June 12 at the State Fairgrounds in Huron. The Outdoor Expo will open its gates at 9:00 a.m. and the auction will begin at 10:00 a.m.
 
Antlers will make up the bulk of auction items. There are over 500 sets of antlers that will be offered individually and numerous shed and miscellaneous antlers that will be auctioned by the pound.  The auction lots include both deer and elk antlers. In addition, there will also be shoulder mounts, mountain lion skulls and bobcat hides offered.
 
“We have an amazing variety of items for auction that should be attractive to hunters, outdoor craft people, and outdoor enthusiasts in general,” Alban said.
 
The proceeds from the auction will be used to offset Department allocations to Sportsmen Against Hunger and the Turn In Poachers (TIPS) Program.

SD Archery Hunters Will Be Able to Use 2-Inch Broadheads While Hunting
 
PIERRE, S.D. – The South Dakota Game Fish and Parks Commission has agreed to allow bow hunters to use broadhead arrows up to 2 inches in diameter while hunting big game in the state.
 
The current rule allows hunters to use only up to 1-7/8 inch broadheads.
 
The rule was changed to conform with updates in standard archery equipment.

South Dakota Will Allow August Canada Geese Hunting
 
PIERRE, S.D. – In an effort to control crop depredation by Canada geese, the South Dakota Game Fish and Parks Commission has decided to allow hunters to participate in an August Canada Goose Take Season this year.
 
The season will be held in 15 counties of 32.
 
The August Canada Goose Take Season will be held in Brookings, Clark, Codington, Day, Deuel, Hamlin, Grant; Kingsbury, Lake, McCook, Marshall, Miner, Minnehaha, Moody and Roberts counties.
 
Hunters participating in the special August season will not need the Federal Migratory Bird Stamp, but all other restrictions are the same as those in effect for the Early Fall and Regular Canada Goose seasons.

U.S. Forest Service To Handle National Grasslands Dog Training Permits
 
PIERRE, S.D. – Dog trainers on horseback who train dogs on National Grasslands in South Dakota will now have to get permits from the National Forest Service.
 
The change has been approved by the South Dakota Game Fish and Parks Commission.
 
Previously, the Game Fish and Parks Department issued those permits on a limited draw basis.

South Dakota West River Deer Season Proposed
 
PIERRE, S.D. – People who hunt in the West River Deer season in South Dakota can  take to the field beginning Nov. 13, if a Game Fish and Parks Commission proposal is adopted in June.
 
The Commission has also proposed season dates of Nov. 6-9 and Nov. 22-28 in Gregory, and Mellette counties; and Nov. 6-28 in Dewey, Ziebach and Corson counties.
 
Other proposed changes from last year’s season would:  reduce resident one-tag licenses by 500; increase two-tag licenses by 3,150,; reduce three-tag licenses by 4,520; reduce nonresident one-tag licenses by 40; increase two-tag licenses by 252; reduce three-tag licenses by 362; change rules language to correctly reflect that the number of licenses issued to nonresidents may not exceed 8 percent, except in unit 58D (the current rule reads 58B); for Unit 02A, change the unit boundary road name from “Viewfield-Hereford Road” to “New Underwood Road”; update language on licenses issued to landowners to reflect a new state law allowing qualifying landowners to receive two antlerless deer licenses free of charge for use during this season.

Black Hills Deer Season Proposed

PIERRE, S.D. – A proposal to offer fewer deer licenses for the Black Hills will be considered next month by the South Dakota Game Fish and Parks Commission.
The proposed season would run from Nov. 1-30, and would offer residents 100 fewer Any Deer tags; 500 fewer Any Whitetail tags; 300 fewer Antlerless Deer tags; and 1,400 fewer Antlerless Whitetail tags.
 
Nonresidents would be offered eight fewer Any Deer tags, 40 fewer Any Whitetail tags, 24 fewer Antlerless Deer tags, and 112 fewer Antlerless Whitetail tags.

Deer Harvest Declines in South Dakota
 
PIERRE, S.D. – South Dakota hunters reported mixed results for the 2009 deer seasons, with weather and unharvested crops playing major roles.
 
Harvest surveys compiled by the Game, Fish and Parks Department show that last year was the first year the statewide deer harvest has fallen in the last ten years.
 
GFP Game Harvest Survey Coordinator Corey Huxoll said an estimated 69,000 white-tailed deer and 18,000 mule deer were harvested during the 2009 hunting seasons, for a total of more than 87,000 deer. That is a reduction of more than 4,000 deer from 2008, but still 41,000 more than the 46,000 deer harvested in 1999.
 
Reductions in the harvest of East River Deer, Muzzleloader Deer, Youth Deer and Black Hills Deer accounted for most of the decline, with an offsetting increase in the West River Deer harvest. Both whitetail buck and doe harvest estimates declined from 2008 by 1,600 and 2,779 respectively. The mule deer buck harvest also decreased from 2008 by 624;  however, the mule doe harvest increased by nearly 800. Mule deer accounted for about 20% of the total harvest.
 
The overall deer harvest success declined statewide from 48 percent in 2008 to 43 percent last year. Harvest success ranged from 23 percent at Sand Lake Refuge to 75 percent for West River Special Buck.
 
Information for surveys is collected in a random post-season sampling of hunters, and Huxoll says the department thanks them for the important role they play in helping gather harvest information for all game species in the state.
 
“It is only through the cooperation of hunters completing harvest report cards that we are able to assess the success of the harvest for each of the deer seasons,” Huxoll said. “Hunter surveys are an efficient, scientifically sound and cost-effective method for assessing harvest mortality on wildlife populations that GFP is responsible for managing.”

Fall Turkey Season and Changes in Muskrat and Mink Trapping Seasons Proposed

 
PIERRE, S.D. – Proposed changes to the 2010 Fall Turkey Season would add Stanley County to the West River Prairie Turkey Unit, create units for Moody and Duel counties and offer approximately 600 more licenses for East River Units.
 
The South Dakota Game Fish and Parks Commission has also proposed that the Fall Turkey Season run from Oct. 1, 2010 – Jan. 31, 2011.
 
The Commission also proposed extending the date that muskrat trapping can occur, on or in muskrat houses, from March 1 to March 15.
 
In addition, the Commission is proposing to add a rule on the marking or claiming of trap locations on public road right-of-ways or public lands prior to the start of the mink season.

Proposed Change to Preserve Bird Tagging Requirements 
 
The South Dakota Game Fish and Parks Commission is proposing changes to the bird tagging requirements on shooting preserves.
 
The current rule would be amended to allow removal of heads, legs and plumage from birds harvested on licensed preserves.
 
Because licensed shooting preserves are considered wildlife processing facilities, they are subject to record-keeping requirements for processing activities. The record-keeping should alleviate any concerns about identifying the sex of birds after processing.
 
The Commission is also proposing to add quail to the list of birds excluded from the identification-marking requirement.

Elk and Bighorn Sheep Seasons Finalized, Two Changes to the Upcoming Antelope Season
 
PIERRE, S.D. – The number of licenses available this year for elk hunters in South Dakota has been trimmed by the state Game, Fish and Parks Commission, which has also finalized the Archery, Black Hills and Prairie Elk hunting seasons.
 
The Archery Elk season will see a reduction in elk licenses from 114 “any elk” and 71 “antlerless elk” licenses in 2009, to 96 “any elk” and 49 “antlerless elk” licenses this year.
 
The Black Hills Elk season will have a reduction of available licenses from 605 “any elk” and 760 “antlerless elk” licenses in 2009 to 495 “any elk” and 570 “antlerless elk” licenses in 2010.
 
The Prairie Elk season will see an increase in available tags from 45 “any elk” and 86 “antlerless elk” in 2009 to 50 “any elk” and 86 “antlerless elk” this year.
 
The GFP Commission also extended the 2010 Bighorn Sheep hunting season. The 2010 season will run from Sept. 1 to Dec. 31.
 
The Commission also made two changes to the 2010 Firearms Antelope season.  Hunters will no longer be able to fill antelope tags during the West River Deer season.  In addition, all unsold or unfilled tags at the conclusion of the Firearms Antelope season will be converted to “doe/kid” tags and be valid for nine consecutive days, beginning on the Saturday after Christmas.

Pheasant and Mourning Dove Seasons Set

PIERRE, S.D. – The Game Fish and Parks Commission has finalized two popular game-bird seasons.
 
The 2010 Pheasant Season will run a total of 79 days, from Oct. 16, 2010,  Jan. 2, 2011. The only change from the 2009 season is the Sand Lake National Wildlife Refuge Pheasant Season, which will be Dec. 13, 2010, to Jan. 2, 2011.
 
The Commission also set the 2010 Mourning Dove season as Sept. 1 – Nov. 9.

Archery Antelope and Deer Seasons Finalized
 
PIERRE, S.D. – The Game Fish and Parks Commission has finalized the 2010 Archery Deer and Archery Antelope Seasons without change from 2009.
 
The 2010 Archery Antelope Season will run Aug. 14 to Oct. 31, except when the Prairie Firearm Antelope season is open. Unlimited resident and nonresident “any antelope” and “any antelope plus two doe/fawn” licenses are available.
 
The 2010 Archery Deer Hunting Season will be Sept. 25, 2010, to Jan. 31, 2011.

Archery Equipment Change Proposed
 
PIERRE, S.D. – If a proposal by the South Dakota Game, Fish and Parks Commission is approved, archery hunters will be allowed to shoot larger mechanical broadhead arrows this year at big game, except elk.
 
The proposal would allow archery hunters to use mechanical broadheads with a maximum cutting diameter of 2 inches.  The current rule allows hunters to use mechanical broadheads with a maximum of 1 7/8 inches.

The Commission will take final action on the measure at its May 6-7 meeting in Custer State Park at the Sylvan Lake Lodge.

PIERRE, S.D. - The South Dakota Game, Fish and Parks Commission has set the 2010 South Dakota Muzzleloader Deer season as Dec. 11, 2010, to Jan. 31, 2011.
 
There will be 1,000 “any deer” licenses available to resident hunters and unlimited single and double “any antlerless” deer licenses available to residents and nonresidents. A hunter may possess no more than five general muzzleloading deer licenses of any type.
 
After Dec. 31, all unfilled licenses will be valid for antlerless deer only.
 
The 2010 Youth Deer Hunting season will run Sept. 11, 2010, to Jan. 31, 2011. The statewide, antlerless-only season is open to residents and nonresident youth who have not reached the age of 18 by June 30.
 
Youth hunters may purchase up to two youth deer licenses and must be accompanied by adults while hunting.

Special Canada Goose, Tundra Swan and Nonresident Waterfowl Hunting License Numbers Finalized

 
PIERRE, S.D. – The South Dakota Game, Fish and Parks Commission has finalized the Special Canada Geese and Tundra Swan seasons and the Nonresident Waterfowl hunting license numbers.
 
The Bennett County Special Canada Geese hunting season will run Oct. 16 to December 19. The Special Geese season has 800 available three-tag Canada goose licenses.
 
The 2010 Tundra Swan hunting season will run Oct. 2 through the end of the light goose hunting season.  All counties east of the Missouri River except Charles Mix, Bon Homme, Yankton, Clay, Union, Lincoln, Turner, Hutchinson and Douglas Counties will be open to hunting.
 
Single-tag tundra swan licenses will be available to 1,100 residents and 200 nonresidents.
 
Nonresident waterfowl hunters will have the same number of licenses available this year as the 2009 season. The maximum number of nonresident waterfowl licenses issued by lottery will be 4,000 special nonresident licenses, 2,000 early fall Canada geese temporary nonresident licenses, 2,000 fall three-day temporary nonresident waterfowl licenses, and 10,000 spring snow geese temporary nonresident licenses.

GFP Commission Proposed August Management Take for Canada Geese
 
PIERRE, S.D. – In an effort to alleviate depredation concerns in eastern South Dakota, the Game, Fish and Parks Commission has proposed an August Management Take of resident Canada geese.
 
The Management Take would allow hunters in Brookings, Clark, Codington, Day, Deuel, Hamlin, Grant, Kingsbury, Lake, McCook, Marshall, Minnehaha, Moody and Roberts counties to shoot eight Canada geese a day from Aug. 14-22.
 
The Commission will take final action on the proposal at its May 6-7 meeting in Custer State Park at the Sylvan Lake Lodge.
 
Residents who would like to provide written comments on the proposals may do so up until 5 p.m. Wednesday, May 5.   Comments may be mailed to Game, Fish and Parks Commission, 523 E. Capitol Ave., Pierre, S.D., 57501, or e-mailed to wildinfo@state.sd.us . All comments must have the senders’ full names and addresses in order to be included in the public record.
 
Comments may also be presented in person at the GFP Commission meeting during the public hearing at 2 p.m. MDT on Thursday, May 6.

Sportsmen Against Hunger Helps Feed the Needy
 
PIERRE, S.D. – Hunters donated about 97,000 pounds of game meat to needy individuals and families across South Dakota during the 2009 hunting seasons through Sportsmen Against Hunger, nearly reaching the organization’s goal of 100,000 pounds.
 
Sportsmen Against Hunger is a non-profit organization whose mission is to find a convenient way for hunters to donate harvested game to needy families.
 
This past year, Sportsmen Against Hunger reimbursed participating meat processors for processing 2,045 antlerless deer and 261 doe/fawn antelope donated by hunters, an increase from the 1,946 antlerless deer and 354 doe/fawn antelope donated in 2008. In addition, hunters donated 245 buck deer, 54 buck antelope, and 5,929 pheasants for which the hunters paid all processing costs.
 
Processed meat is periodically collected from participating processors and distributed to needy families and individuals across the state through more than 60 food pantries, which frequently are in short supply of fresh meat. Commercially processed game meat was also donated to food banks through a clean-out-your-freezer food drive in many areas, or was taken directly to food banks.
 
Total donations in 2009 amounted to 390,000 healthy meals for the needy.
 
“The generosity of hunters never ceases to amaze me” said Jeff Olson, president of South Dakota Sportsmen Against Hunger. “I am surprised by the increase, as donations of deer and antelope to SAH programs across the country were down in many states last fall. To show any increase at all really shows the sportsmen are becoming even more dedicated to this program in South Dakota.”
 
Sportsmen Against Hunger reimburses participating processors $50 for each antlerless deer donated. The certificate program is costly and the organization is always looking for new ways to fund the program.
 
Last season, sportsmen donated almost $30,000 to SAH through an optional check-off program when applying for big-game tags. Hunters are encouraged to support the program by contributing through the check-off program when applying for 2010 tags.

The Game, Fish and Parks Department, through the GFP Commission, has been a significant supporter of Sportsmen Against Hunger. “Many people contribute to the continuing success of Sportsmen Against Hunger,” Olson said. “They include hunters who harvest a few more deer than they would normally take, the 49 participating game processors who generally reduce their fees for processing donated game, food pantries that distribute the donated game meat, and hunters, private donors and corporations making generous contributions to the program in South Dakota.”
 
“Sportsmen Against Hunger volunteers, and all those who have benefited from the donated meat would like to send a big ‘Thank You’ to all participants in yet another banner year for the program,” he said.

Pheasant Harvest Near 1.7 Million in 2009
 
PIERRE, S.D. – The Game, Fish and Parks Department estimates that South Dakota’s pheasant harvest in 2009 was just short of 1.7 million roosters.
 
“We complete a science-based random survey of hunters each year at the end of the hunting seasons,” said Corey Huxoll, GFP harvest surveys coordinator. “Thanks to the overwhelming response these hunters provide us, we are able to get an accurate picture of their success.”
 
A survey of those who hunt upland birds – pheasants, grouse and partridge – indicates that more than 70,000 South Dakota residents and nearly 98,000 nonresidents hunted as least one of those species last year.

Hunters harvested an average of 10 birds.  The 1.7 million birds was the 6th highest in the past 40 years.
 
In addition to the pheasant harvest, hunters took more than 39,000 sharp-tailed grouse and prairie chickens during the 2009 hunting season, and 8,500 partridge.

Volunteer Hunter Program—Connecting Hunters and Landowners
 
PIERRE, S.D. – Building on the success of the “Voluntary Antlerless Deer Program”, the South Dakota Game, Fish and Parks Department has recently expanded the program to include antelope, deer, turkeys and Canada geese.
 
The expanded program, the “Volunteer Hunter Program,” will allow hunters to use a GFP Web site to add their names on a list that will allow them to be directly contacted by landowners willing to open their property to those hunters. 
 
“In certain portions of the state, we have game populations that exceed their population management objectives,” explained Keith Fisk, GFP wildlife damage program administrator. “Hunting remains our most effective tool for managing wildlife populations, and this program is a simple and effective way of linking hunters with accommodating landowners.”
 
Hunters will need to have the appropriate license before joining the program.
 
They can access the Volunteer Hunter Program with the same usernames and passwords they have used to apply for licenses through the GFP online licensing system. Landowners can view the list of willing hunters on the Web site page.

By using or accessing this website (the "Site"), or by using any of the content hosting and sharing services provided via the Site ("Services"), you agree to be bound by these Terms of Service and by the Privacy Policy of Whitetail Domains LLC ("Whitetail Domains"), which are collectively referred to as the "Agreement." Please read the terms of this Agreement carefully. If you do not agree to the terms of this Agreement, then you may not use or access the Site or any of the Services of Whitetail Domains.

This Agreement sets forth the legally binding terms for your use of Whitetail Domains’s many individual Services. Whitetail Domains may, in its sole discretion, modify this Agreement from time to time, and may modify, suspend, or terminate the Site and Services, for any reason, and without notice. Although you may be asked to indicate your assent to the terms of this Agreement only once (e.g., when you register for a Whitetail Domains account), the terms of this Agreement, as modified by Whitetail Domains from time to time, will govern all use of the Site and Services. By continuing to use or access the Site or any of the Services, you agree to be bound by the Terms of Service in effect at the time of such use or access.

Description Of The Service

Whitetail Domains provides its Registered Users (defined below) with the ability to host a variety of content, including without limitation images and videos (including any audio accompanying the videos) ("Content") that Registered Users own or to which they have the necessary rights ("User Content"), in order to share User Content via the Web. Visitors, or “Guests” to the Site may view or share certain aspects of the User Content, but Guest Users are restricted via the website from viewing certain User Content or sharing certain User Content. Under the current terms of this Agreement, Guest and Registered Users will enjoy these Services free of charge. Members of Whitetail Domains are users of the system who pay a nominal fee for the ranch and/or lease management portion of the website. Members of Whitetail Domains have the highest level of services and access to the system and Members enjoy the ability to maintain a private website for their own ranch and/or lease and/or hunting club (“Hunting Club”). Members further enjoy a complete record management system for their Hunting Club and only current members of their own club may share User Content between and amongst other current members of the Hunting Club.

Although the Site and Services are normally available, there will be occasions when the Site or Services will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Whitetail Domains. Also, although Whitetail Domains will normally only delete Content that violates this Agreement, Whitetail Domains reserves the right to delete any Content for any reason, without prior notice. Deleted content may be stored by Whitetail Domains in order to comply with certain legal obligations and is not retrievable without a valid court order. Consequently, Whitetail Domains encourages you to maintain your own backup of your User Content. In other words, Whitetail Domains is not a backup service. As discussed further in this document, Whitetail Domains will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content.

Whitetail Domains.com has the exclusive right to modify this Agreement as it feels necessary. Such modifications are in affect from the moment upon posting to the WhitetailDomains.com website. Whitetail Domains does not permit the use of photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other Whitetail Domains.com Users may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services. WhitetailDomains.com assumes no responsibility or liability for this material whatsoever. If you become aware of the misuse of the Services by any person, please contact Whitetail Domains.com immediately.

WhitetailDomains.com reserves the right to reject, refuse to post or remove any posting by its Registered Users or Members, or to restrict, suspend, or terminate access to all or any part of its Services at any time, for any without prior notice, and without liability.

User Accounts And Passwords

Use of and Membership in the Services is void where prohibited. By using the Services, you represent and warrant that (i) all registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; (iii) your use of the Services does not violate any applicable law or regulation. Your account may be deleted and your utilization of the Site may be terminated without warning, if we believe that these guidelines are not upheld.

Once you have created an account, you will be a "Registered User." Registered Users are limited to one free account per person. You may also upgrade to a "Member" account by paying a membership fee which enables your access to the ranch and/or lease and herd management system. Your Whitetail Domains account is solely for your own personal use and benefit. You are responsible for safeguarding the password that you use to access the Site and Services. You agree not to disclose your password to any third party nor to permit any third party to use your Whitetail Domains account. You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions. You will immediately notify Whitetail Domains of any unauthorized use of your password. In registering and creating an account, you agree to provide accurate, current and complete information, and to promptly update that information as necessary. Whitetail Domains will have no liability for failure to deliver notices that result from inaccurate account information.

At any time and at the sole discretion of Whitetail Domains, you may be limited to the file size, bandwidth, and storage limitations related to your account level. Whitetail Domains reserves the right , with prior written notice, to disable Users that are using excessive bandwidth or otherwise abusing the system. Whitetail Domains has the right to change its file size, bandwidth, or storage limitations without notice.

You acknowledge that Whitetail Domains reserves the right to charge for its Guest and Registered User Services and to change its fees from time to time for all User types at its discretion. If and when Whitetail Domains chooses to charge a fee for Guests or Registered Users, you will be so notified and bound to the terms herein. Failure to accept the terms of this agreement will result in the suspension of your account. Termination of your Membership because you have breached the Agreement, shall not be entitled to any applicable refund of any unused portion of applicable subscription fees.

This Agreement shall remain in full force and effect while you use the Services as a Guest or Registered User, or are a Member. Members of Whitetail Domains are billed annually in advance, and in the absence of your termination of your Membership status, your Membership will be renewed automatically each year on the anniversary date of your initial subscription date. You may terminate your Membership at any time, for any reason, by following the instructions on the Member Registration page. Termination becomes effective at the end of your then current annual subscription period, and Whitetail Domains is not obliged to refund any unused potion of your Membership fees. Your License To Whitetail Domains

Whitetail Domains does not claim any ownership rights in any User Content that you choose to post to the Site. After posting User Content to the Site, you continue to retain all ownership or license rights in your User Content and you continue to have the right to use your User Content as you did prior to such posting. Further, Whitetail Domains will not disclose either on the Site or to any 3rd party any User data marked as “private”, nor will Whitetail Domains disclose any personal data about you, including you name, your ranch name (if marked as private), address, and other contact information (such as email addresses) to any 3rd party.

However, by posting or making User Content available through the Site or via the Services, you hereby grant to Whitetail Domains a nonexclusive, royalty-free, transferable, worldwide license to use, copy, modify, prepare derivative works from, distribute, publicly display and publicly perform (whether by means of a digital audio transmission or otherwise) and process your User Content, or any part of it, solely on and through the Site and Services, including without limitation (a) adapting the format of your User Content (for example by encoding or transcoding) for suitable display on the Site; and (b) displaying, in Whitetail Domains's sole discretion, your public User Content in search results generated by the Whitetail Domains search engine. In addition, where you have made your User Content public, posted a link to your User Content on another website or otherwise shared a link to your User Content, you grant to Whitetail Domains a nonexclusive, royalty-free, worldwide right to sublicense the right to copy, modify, prepare derivative works from, and distribute your User Content as necessary to perform the Services, including without limitation any services outsourced by Whitetail Domains. In connection with the above license, you provide your consent for Whitetail Domains personnel, including Whitetail Domains contractors and service providers, to view your User Content at any time for the purpose of providing the Services and filtering content that violates this Agreement. You acknowledge that you are solely responsible for all Content you submit to the Site or provide to the Service. You represent that you either own the User Content or have the rights necessary to grant Whitetail Domains this license.

Whitetail Domains's Limited License To You

Subject to your compliance with the terms and conditions of this Agreement, Whitetail Domains grants you a non-transferable, non-sublicensable right to access, view and print public Content, only for your personal, non-commercial use. With the exception of your User Content, you may not distribute any Content to third parties, use any Content commercially (except as may be permitted by a separate license explicitly attached to a particular piece of Content), or otherwise copy, modify, distribute, publicly display or perform any Content (except as such acts may be permitted by a separate license explicitly attached to such Content).

Restrictions

You will not do any of the following while using or accessing the Site or the Services:

  • Post, upload, email or otherwise transmit, without first obtaining the permission of Whitetail Domains, any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, "pyramid schemes," Ponzi schemes or any other form of solicitation;
  • Post, upload, email, or otherwise transmit, via the Site or Services, any Content that is unlawful, obscene, harmful, threatening, harassing, defamatory, or hateful, or that contains objects or symbols of hate, invades the privacy of any third party, contains nudity or pornography (including without limitation any child pornography or child erotica), is deceptive, threatening, abusive, inciting to unlawful action, defamatory, libelous, vulgar or violent, or constitutes hate speech, or is otherwise objectionable in the opinion of Whitetail Domains;
  • Post, upload, email, or otherwise transmit any Content that contains software viruses or any other computer code, files, or programs designed to (i) interrupt, destroy, or limit the functionality of any computer software; or (ii) interfere with the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site;
  • Post, upload, email or otherwise transmit any Content that includes code that is hidden or otherwise surreptitiously contained within the images, audio or video of any Content that is unrelated to the immediate, aesthetic nature of the Content;
  • Attempt to probe, scan or test the vulnerability of any Whitetail Domains system or network or breach any security or authentication measures;
  • Forge any TCP/IP packet header or any part of the header information in any posting, or in any way use the Site or Services to send altered, deceptive, or false source-identifying information;
  • Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure protecting the Site or Services;
  • Collect or store personal data about other users without their express permission;
  • Impersonate or misrepresent your affiliation with any person or entity, through pretexting or any other form of social engineering, or otherwise commit fraud;
  • Resell the Services, in whole or in part;
  • Violate any applicable law, regulation, or ordinance; or
  • Use the Site or Services in any manner not permitted by this Agreement.


Whitetail Domains does not control the Content in Registered Users and Members accounts and does not have any obligation to monitor such Content for any purpose. However, on both free and Member accounts, and regardless of whether the Content is public or private, Whitetail Domains may choose to monitor such Content at any time, in its sole discretion. Whitetail Domains reserves the right at all times to terminate your account, and delete any and all Content, in whole or in part, for any reason including without limitation violations of this Section, or of any part of this Agreement. Whitetail Domains reserves the right at all times to disclose, in its sole discretion, any Content as necessary to (a) satisfy any law, regulation, or governmental request or (b) reduce or prevent what Whitetail Domains considers to be, in its sole discretion, a serious or imminent threat to your health or safety, or the health or safety of another. For information regarding Whitetail Domains handling of your personally identifiable information, refer to the Whitetail Domains Privacy Policy.

Age Requirements

Users of the Services must be at least 13 years of age. Children under the age of 13 are not permitted to use the Service and no information of children under the age of 13 will be knowingly collected by Whitetail Domains. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without the parent or guardian's consent by, for example, misrepresenting his or her age, that parent or guardian should contact us at the Contact Us page. If Whitetail Domains determines that it has collected personal information of children under the age of 13, Whitetail Domains will immediately delete such information and any accounts believed to be held by children under 13.

Disclaimer Of Warranty

THE SERVICES, CONTENT, SITE, AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WHITETAIL DOMAINS DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitations Of Liability

You understand that Content is posted by users and that Whitetail Domains has only limited control over the Content that is made available via the Site and Services. You understand that by using the Site and Services, you may be exposed to this Content. You acknowledge that Whitetail Domains will not be liable for
  • Content, including without limitation the subject matter of any Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use or download of any Content posted, emailed, transmitted, or otherwise made available via the Site or Services;

IN NO EVENT WILL WHITETAIL DOMAINS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF DATA, SERVICE INTERRUPTION, COMPUTER FAILURE, OR PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SITE OR ANY SERVICES, WHETHER BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR STRICT LIABILITY OR OTHER THEORY EVEN IF WHITETAIL DOMAINS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL WHITETAIL DOMAINS' AGGREGATE LIABILITY TO YOU OR TO ANY THIRD PARTY FOR ANY AND ALL CLAIMS ARISING OUT OF THE USE OF THE SITE OR ANY SERVICES EXCEED THE AMOUNTS YOU HAVE PAID TO WHITETAIL DOMAINS. You acknowledge that Whitetail Domains has set its prices and entered into this Agreement in reliance upon the limitations of liability specified herein, which allocate the risk between the parties and form a basis of the bargain between the parties. Some jurisdictions do not allow the exclusion or limitation of liability of incidental or consequential damages, so the above limitation may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Whitetail Domains and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or Services, or your violation of this Agreement. Whitetail Domains reserves the right, at its own expense, to assume the exclusive defense and control of any such claim otherwise subject to defense by you, in which event you will cooperate with Whitetail Domains and its counsel, as necessary, in the conduct of such defense.

Forum And Choice Of Law

This Agreement will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this Agreement or your use of the Services will be filed only in the federal courts located in the State of Texas, or state courts located in Fort Bend County, Texas. You further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, or related to, use of the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose, or be forever barred. Disputes must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in Houston, Texas.

Refund Policy

Whitetail Domains will not honor any refunds for any paid Whitetail Domains services, including without limitation Member account payments, more than thirty (30) days after you last submitted such payment to Whitetail Domains. General

You may not assign any rights granted to you or delegate any of your duties hereunder; any attempt to do so is void and of no effect. Whitetail Domains may assign its rights and delegate its duties under this Agreement in their entirety in connection with a merger, reorganization or sale of all, or substantially all, of its assets relating to this Agreement. The failure of Whitetail Domains at any time to require performance of any provision hereof shall in no manner affect its right at a later time to enforce the same unless the same is waived in writing. If a court should find that one or more rights or provisions contained in this Agreement are invalid, you agree that the remainder of the Agreement will be enforceable. The headings and captions are for convenience only and are not to be used in the interpretation of this Agreement. This Agreement constitutes the complete and exclusive understanding and agreement between you and Whitetail Domains regarding its subject matter, and supersedes all prior and contemporaneous agreements or understandings relating to such subject matter.
