Wildlife Affected by Flooding

NASHVILLE --- As flooding continues to be an issue primarily in the west and middle areas of the state, Tennessee Wildlife Resources Agency officials are advising residents they might encounter wildlife in unusual places.
 
“As the waters continue to rise, animals are fleeing their normal habitat areas and our residents should not be surprised to see them seeking temporary refuge,” said Chad Harden, TWRA Region I Big Game Coordinator. “Animals that appear to be in need of rescue should be left alone. They are under stress, but their natural survival instincts will help them cope with the situation until things get back to normal. The animals could pose a real danger to someone who might try to rescue them.”
 
Deer will be the most noticeable animal that will be evacuating their normal habitat areas. Officials said the animals will return to their normal ranges once the flood waters recede.

2010-11 Deer Seasons Drawing to a Close

NASHVILLE --- Tennessee’s 2010-11 deer hunting seasons are drawing to a close. The statewide season for gun, muzzleloader and archery will conclude Jan. 9 while the Young Sportsman Hunt will be held the weekend of Jan. 15-16.
 
The second segment of gun season for deer began Dec. 18. A total of 27,050 deer have been harvested in the second segment with Franklin County leading the way with 1,143 deer reported. Lincoln County is second with 1,111 deer followed by Giles County 1,106, Fayette County 1,083, and Henry County 1,001.
 
Since archery season began in late September, 151,449 deer have been harvested statewide, which totals 933 less over the same period from last year. However, this year’s second segment total surpasses last year’s mark of 26,179 deer heading down the stretch. The top five overall counties heading down the stretch and their harvest for this year are Giles County (4,788), Henry County (4,543), Fayette County (4,235), Hardeman County (4,192), and Lincoln County (3,964).
 
For the Young Sportsman Hunt, only youth ages 6-16 may participate regardless of whether they possess a junior or adult license. Each youth must be accompanied by a non-hunting adult, 21 years or older, who does not need a license but must also wear 500 square inches of fluorescent orange.
 
Youth hunters, ages 10-16 need a hunter education card along with the appropriate license(s) and/or permits. Those hunters, ages 6-9, are not required to possess a hunter education card or license. These hunters are required to have their Social Security number to check in a deer.
 
For those youth hunters, ages 10 and older, who have not taken the hunter education course, the Apprentice License is available. The Apprentice License exempts a hunter, age 10 or older who falls within the hunter education requirement, from having to complete the mandatory Hunter Education Course for one year.

Young Sportsman Deer Harvest Sees Increase; Muzzleloader Season Begins Nov. 6

NASHVILLE --- Tennessee’s youth hunters had a busy weekend of deer hunting across the state in the Young Sportsman Hunt and the harvest numbers show an increase over the 2009 weekend hunt.
 
The youth hunters (ages 6-16) harvested 8,818 deer, an increase of 616 over the 2009 totals as reported by the Tennessee Wildlife Resources Agency.
 
Giles County was the top county for the youth hunt with 271 deer harvested. Border counties Weakley and Henry tied for second with 210 each, followed by Fayette 201, Lincoln 197, Hardeman 185, Maury 168, Cumberland 167, Carroll 160, and Hawkins 156. The second designated Young Sportsman Hunt will be Jan. 15-16, 2011.
 
Tennessee’s Muzzleloader Deer Season opens on Saturday, Nov. 6 and goes through Friday, Nov. 19 in all three of Tennessee’s deer hunting units, according to the TWRA.
 
For Unit B (East Tennessee) counties, the dates for antlerless deer hunting depend on the county hunted. Blount, Campbell, Carter, Cocke, Hamblen, Jefferson, Loudon, Monroe, Sevier, Unicoi, Union, and Washington counties are Nov. 6-10. Anderson, Claiborne, Fentress, Grainger, Greene, Hancock, Hawkins, Johnson, Knox, Morgan, Pickett, Polk, Scott, and Sullivan counties are Nov. 6-19. Only one antlerless deer may be taken during this season, however, any of the three antlered deer not already taken may be harvested during this season as well.
 
The statewide bag limit for antlered bucks is three. No more than one antlered deer may be taken per day. Hunters are allowed the following antlerless bag limit during this segment of muzzleloader season: Unit A -4 antlerless deer; Unit L-3 antlerless deer per day and Unit B-1 antlerless deer.
 
For the exact boundaries of the different deer units, hunters can refer to the 2010 Tennessee Hunting and Trapping Guide, available where hunting and fishing licenses are sold and at all TWRA offices. The guide can also be viewed at TWRA’s website at www.tnwildlife.org.
 
Muzzleloading firearms of .40 caliber minimum plus long bows, compound bows and crossbows are legal hunting equipment for this season. 
 
Resident hunters, ages 16 through 64 must possess in addition to other appropriate licenses, an annual big game license for the equipment used. Lifetime Sportsman license, Junior Hunt/Trap/Fish, Adult Sportsman license and Permanent Senior Citizens license holders are not required to purchase supplemental big game licenses.
 
In addition to private lands, including public hunting areas, several wildlife management areas (WMAs) will be open to hunters during this muzzleloader season. Hunters need to refer to the 2010 Hunting and Trapping Guide for a listing of these WMAs or go to TWRA’s website.

AEDC WMA Units 1 & 2 November, December Permits To Go On Sale Oct. 27

NASHVILLE --- The Tennessee Wildlife Resources Agency has announced the Arnold Engineering Development Center (AEDC) Wildlife Management Area units 1 & 2 permits first come, first serve November and December deer permits will go on sale Oct. 27 at 8 a.m. (CDT). These will be the final first come, first serve deer hunts to occur for this year’s hunting season.
 
The permits can be purchased through the TWRA website at www.tnwildlife.org by clicking “Buy a License Here” icon located on the right side of the home page. The permits can also be purchased at any TWRA licensing agent.
 
Hunters who purchase the permit are reminded that they will need to retain their receipt. The receipt will serve as the permit. No phone sales will be accepted.
 
A permit fee will not be charged to Annual Sportsman (Type 004) or Lifetime Sportsman (Types 402 thru 405) license holders or Senior Citizen Hunters (Type 166) with an Annual Senior Citizen Permit (Type 167). For all other license holders, the cost is $20 per permit, plus agent fee.
 
Customers can only obtain one permit per hunt choice. There are four hunt choices for November and one hunt choice for December. Customers can obtain one permit for each hunt choice for a total of five permits per person.
 
First come, first serve permits are sold one at a time per transaction. Customers can purchase permits for others as long as they have all their pertinent information. The same one permit per hunt choice applies.
 
The privilege codes for the first come, first serve AEDC WMA permits are as follows:
 
            345 for Lifetime and Annual Sportsman and Seniors holding a current Type 167
            346 for all other license holders.
 
This applies to youths and adults purchasing a permit.

 Free Youth Deer Hunt Contest Underway; Opportunity to Record First Harvest

Deer Archery Hunters See Increase in Opening Weekend Harvest

Tennessee’s deer archery hunters saw an increase in their harvest from 2009 on the opening weekend of the 2010 season. A total of 2,401 deer were taken, an increase of 163, with all 95 counties reporting harvests. 

Montgomery County led the opening weekend (Sept. 25-26) totals with 75 harvests, edging the 2009 leader, Giles County’s reporting total of 72. (more)

Tennessee’s Deer Archery Season Kicks Off Sept. 25

NASHVILLE --- The Tennessee Wildlife Resources Agency expects bowhunters to be out in force for Tennessee’s 2010 archery deer hunting season which kicks off on Saturday, Sept. 25.
 
The deer archery season will again be divided into three segments statewide this year. The first segment runs from Sept. 25-Oct. 29 while the remaining two will be Nov. 1-5, and Dec. 6-17.
 
For better wildlife management, Tennessee is divided into the three deer units-A, B, and L. The anterlesss deer bag limit for each unit is: Unit A -4; Unit B -2; and Unit L -3 per day. (A map identifying the Deer Management Units can be found on page 24 of the 2010 Tennessee Hunting and Trapping Guide and on the TWRA website).
 
The antlered deer bag limit is a total of three for the year. A hunter may take his or her three antlered deer during any season, but no more than one per day. There is no longer the requirement to change units or seasons in order to take three antlered deer.
 
Anyone born on or after January 1, 1969 is required to carry proof of satisfactory completion of a hunter education class or be in possession of the Apprentice Hunting License (along with other required licenses) while hunting any species in Tennessee.
 
In 2009, Tennessee sportsmen harvested more than 2,200 deer on the two-day opening weekend. Giles County had 77 deer harvested to edge Montgomery County’s 74 for the top opening weekend. Lincoln County was third with 67, followed by Carter County 60, Cumberland County and Henry County 51, Hawkins County 50, Hardeman County and Johnson County 49, Stewart County 47 and Hamilton County had 45 to be the top opening weekend harvest counties.

Changes Made to Deer Carcass Importation Proclamation

NASHVILLE --- The Tennessee Wildlife Resources Commission has made an amendment to a proclamation that was established in May concerning the addition of states from which deer carcasses are prohibited for importation unless bones were removed to aid in the prevention of chronic wasting disease (CWD) in Tennessee.
 
Tennessee Wildlife Resources Agency officials had earlier recommended that the states of Virginia and Missouri along with the entire state of Illinois be added to the list of states to be included in the prohibition. The prohibitions came as a response to the discovery of CWD in white-tailed deer in these states.
 
After internal discussion on the enforceability of these regulations and discussions with the affected states, the TWRA recommended that the prohibition zones in four states (Illinois, Missouri, Virginia and West Virginia) be reduced to those areas where CWD is known to occur or where the affected state has established containment zones. The TWRA proposed the change in an effort to lessen the burden on state sportsmen while still providing adequate protection of Tennessee’s deer population from CWD.
 
The Virginia counties that are affected are Frederick and Shenandoah. Hampshire County in West Virginia and Linn County in Missouri are the only affected counties in those respective states. In Illinois, the area continues to be that north of Interstate 80.
 
Chronic wasting disease is a serious neurologic disease of white-tailed deer and other ungulates such as elk. Tennessee has adopted a number of measures, both for wildlife and farm animals, to reduce the likelihood that CWD might be introduced into the state.

Hunters Reminded About 2010 Special Season Deer Changes

NASHVILLE --- Hunters are reminded by the Tennessee Wildlife Resources Agency the special season fall turkey hunts and county deer quota hunts have been changed to non-quota hunts in many counties across the state.
 
 The change will eliminate the need for hunters to obtain a quota permit prior to the hunt. Hunters will be able to participate in any non-quota hunt in a county where the hunt is established. A Type 094 non-quota permit will be required except for sportsmen license holders (including lifetime licenses) and individuals eligible for the landowner exemption.
 
These tables provide the dates each county is open for antlerless deer gun hunting and fall turkey hunting. If a sportsman wishes to participate in either of these seasons, he or she should simply find the county that is desired to hunt, check the dates the county is open, and follow the bag limits listed within the table. Hunters need to keep in mind; Unit L counties are open throughout the entire gun season with a three antlerless deer per day bag limit. If a county is not listed in the table (except Unit L deer), it is closed for antlerless gun or fall turkey hunting.

Second Elk Hunt Winners to be Announced at June Commission Meeting

The four winners selected to participate in Tennessee’s second managed elk hunt will be announced during the June meeting of the Tennessee Wildlife Resources Commission on Wednesday, June 16.
This month’s meeting will be held on one day rather than the regular two-day format. The June meeting will begin at 10 a.m. in the Tennessee Wildlife Resources Agency Region II Ray Bell Office Building. (more)

Application Period June 16-July 21 for 2010 WMA Big Game Quota Hunts

The application period for all Wildlife Management Area (WMA) 2010 Big Game Quota Hunts will run from June 16 through July 21, the Tennessee Wildlife Resources Agency has announced.
Applications are available and will be accepted at any TWRA license agent, TWRA regional office, or online at the TWRA Web site at www.tnwildlife.org. Mailed applications will not be accepted. The application must be received by midnight (CDT) on July 21. (more)

NASHVILLE --- In Thursday’s (May 20) Tennessee Wildlife Resources Commission meeting, action was taken during the 2010-11 hunting seasons-setting process which reduced the bear archery season to three weeks from the originally proposed five week season in Blount, Carter, Cocke, Greene, Jefferson, Johnson, Monroe, Polk, Sevier, Sullivan, Unicoi, and Washington counties.
 
The change by the TWRC was in response to discussions related to calls that some commissioners had received in reference to the length of the season. While there was some similar discussion at the April TWRC meeting when the season recommendations were previewed, the recommendation to shorten the bear archery hunting season was not specifically on the commission agenda for the May meeting.
 
In reference to that change, Mike Chase, TWRC Chairman, stated “My concern is perhaps ample time was not given for other opinions to be considered. Given the volume of regulations and seasons we had to address during our meeting, that is sometimes difficult to do. We want to make absolutely sure that all sides are considered before we finalize this year’s regulations for bear hunting.
 
 “Therefore, if the change in the season length is a concern to the archery community, I would ask those hunters contact their local TWRC member or they can send their comments to the following link:. twra.comment@tn.gov. If there appears to be a desire for the commission to readdress that issue, we will gladly do so at the June commission meeting.”

Application Period Deadline Approaching for State’s Second Elk Hunt

NASHVILLE --- Time is winding down to apply for participation in Tennessee’s second-ever managed elk hunt. Sportsmen have until midnight (CDT) on May 31 to submit their application to the Tennessee Wildlife Resources Agency.
 
The second elk hunt will be held Oct. 18-22, 2010 at the North Cumberland Wildlife Management Area, located off I-75, north of Knoxville. Once again, there will be five Elk Hunting Zones designated at the WMA.
 
Persons may apply at any TWRA license agent, TWRA regional office or online at www.tnelkhunt.org. Mailed applications will not be accepted.
 
As in the first hunt, five individuals will be selected to participate. Four of the participants will be selected through a computer drawing conducted by the TWRA. The fifth participant will be the recipient of a permit that is donated to a NGO (Non-Governmental Organization) which this year was the Rocky Mountain Elk Foundation. Fund-raising proceeds are designated to the TWRA Elk Program.
 
In the inaugural hunt, all five participants harvested an elk. Four came on the opening day of the hunt. The 2009 participants in the historic hunt were Craig Gardner (Parrotsville), Chuck Flynn (Rockford), Tami Miller (Franklin), Jeff Moses Cleveland), and Ron Woodard (Oak Ridge).
 
There is no application fee for current Tennessee Annual Sportsman License holders, Lifetime Sportsman License holders, or senior citizen hunters (Type 166) with an Annual Senior Citizen Permit (Type 167). All other applicants will be charged a $10 non-refundable permit fee, a $2 internet usage fee (if applying online) and $0.50 drawing fee (the internet and drawing fees are charged by the internet provider). For those applying at a license agent, there is a $1 agent fee in addition to the $10 non-refundable permit fee.
  
The successful applicants will be announced at the June meeting of the Tennessee Wildlife Resources Commission. Successful applicants will not be allowed to reapply for an elk quota permit for 10 years following a successful draw.

2010 Spring Turkey Harvest Breaks Previous Record


NASHVILLE --- Tennessee turkey hunters have shattered the record for the spring harvest as the 2010 season has come to a close. The previous record for the spring season was 35,877 and this year’s mark is 36,781 and that number is expected to increase as reports continue to trickle in to the Tennessee Wildlife Resources Agency.
 
The spring turkey statewide season came to a close on May 16. The harvest totals represent an increase of more than 4,700 turkeys from the 2009 totals of just over 32,000.
 
Maury County and Montgomery County, which had entered the home stretch of the season as the statewide leaders, kept their momentum to finish first and second. Maury County had 1,022 birds harvested with Montgomery having 958.
 
Henry County was third with 886, followed by Greene (877), Dickson (845), Sumner (820), Giles (787), Rutherford (774), Hawkins (729), and Marshall rounded out the top 10 (699).
 
The 2010-11 hunting seasons will be approved by the Tennessee Wildlife Resources Commission at its May meeting to be held in Nashville.

2010-11 Hunting Seasons Established During TWRC May Meeting

 
NASHVILLE --- The Tennessee Wildlife Resources Commission approved the statewide 2010-11 hunting seasons during its May meeting. The upcoming hunting seasons will have a few slight changes as approved by the commission.
 
Tennessee Wildlife Resources Agency personnel previewed the recommendations at last month’s TWRC meeting and again during the committee meetings at the May meeting. Most of the state’s hunting seasons’ dates and standard bag limits will remain similar for 2010-11.
 
No changes were made concerning deer season dates or to standard antlered and antlerless bag limits. Six Unit B counties will have more antlerless muzzleloader opportunities as a result of a move from the 5-day to the 14-day antlerless hunt. The counties in which the changes apply to are Anderson, Claiborne, Grainger, Greene, Hancock, and Johnson.
 
Hunters are required to check-in animals on the calendar day in which they are harvested also to aid in the agency’s law enforcement efforts. Internet check-in for bears has been eliminated to allow better data collection and to improve enforcement. 
 
The TWRC amended the agency’s proposals and created two new hog hunts on the Cumberland Plateau. Cumberland, Fentress, Overton, and Pickett counties will now allow the hunting of wild hogs with dogs during the time frames of Oct. 2-10 and Dec. 31-Jan. 3. A new wild hog hunt (with dogs) has been created in Monroe and Polk counties Dec. 31-Jan. 3. Also, in the same two counties is the establishment of a bear dog training session that will run from Sept. 9-14. A no bag limit on wild hogs has been set for the South Cherokee National Forest.
 
The commission reduced the bear archery season to three weeks from the agency’s recommendation of a five week season. The bear archery season will now begin Sept. 25 and continue through Oct. 15 in Blount, Carter, Cocke, Greene, Jefferson, Johnson, Monroe, Polk, Sevier, Sullivan, Unicoi, and Washington counties.
 
A computerized drawing system for blind sites for Bogota and the new Thorny Cypress Wildlife Management Area in Dyer County and the four units on the Chickamauga WMA (Candies Creek, Johnson Bottoms, Rogers Creek, and Yellow Creek) will be implemented for next season. More information on the application process will be announced at a later date.
 
The special season fall turkey hunts and county deer quota hunts have been changed to non-quota hunts in many counties across the state. This change will eliminate the need for hunters to obtain a quota permit prior to the hunt. Hunters will be able to participate in any non-quota hunt in a county where the hunt is established. Last Spring’s Turkey Harvest Passed; Season Continues Through May 16


NASHVILLE --- The 2010 spring turkey harvest has already surpassed the total number for the 2009 season, the Tennessee Wildlife Resources Agency reports. The 2010 statewide spring turkey season continues through May 16.
 
Heading into the first of the two final weekends of the statewide season, 33,764 birds have been harvested. The 2009 spring season total was 32,081.
 
Maury County has the top county harvest thus far with 919. Montgomery has the second highest county total with 862 followed by Greene (794), Henry (791), Dickson (775), Sumner (767), Giles (719), Hawkins (690), Rutherford (680), Marshall (648), Hardeman (611), Robertson (609), and Cheatham (603).
 
Tennessee sportsmen are on trek to pass the highest mark since 2007 when the total harvest was 34,256. The record harvest was the previous season in 2006 when more than 38,000 birds were harvested.
 
All Tennessee counties are open to wild turkey hunting including Wildlife Management Areas and refuges unless specifically listed. For specifics on 2010 spring turkey hunting, sportsmen should check the 2009 Tennessee Hunting and Trapping Guide which is available at any TWRA Regional Office, license agent or online at www.tnwildlife.org.

Hunting Seasons Recommendations Among Business Scheduled for April TWRC Meeting

NASHVILLE --- The Tennessee Wildlife Resources Commission will hold its regularly scheduled meeting on Wednesday-Thursday, April 21-22, at the Tennessee Wildlife Resources Agency Region II Ray Bell Building in Nashville. The TWRC meeting begins at 1 p.m. on April 21 and 9 a.m. on April 22. The public is invited to attend.
 
Among the items on the April agenda will be the Tennessee Wildlife Resources Agency’s recommendations for the 2010-11 hunting and trapping seasons. Among the major recommendations for 2010-11:
 
  • Clarify “hog” nomenclature to match T.C.A. 70-1-101. All feral hogs and wild boar will be referred to as wild hogs. The TWRA will make a recommendation that all feral hogs and wild boar be referred to as wild hogs. The TWRA is recommending the change to comply with an agreement that the agency made with the Department of Agriculture to only refer to “wild hogs” in TWRA’s nomenclature, to enable Agriculture to better enforce its regulations on importation and transport of swine. This change would affect several proclamations, including Big Game, Manner and Means and Wildlife Management Areas.
 
  • Liberalize antlerless muzzleloader opportunities in six Unit B counties.
 
  • Eliminate all special season deer and turkey quota hunts and establish comparable non-quota hunt opportunities. This change will eliminate the need for sportsmen to obtain quota permits for deer and/or fall turkey hunts in the counties, and allow them to participate in non-quota hunts, with a Type 94 Non-quota permit, or Sportsman License as appropriate.
 
  •  Establish a new wild hog hunt (with dogs) in Monroe and Polk counties (Dec. 31-Jan.3).
 
  • Establish a bear dog training season in Monroe and Polk counties, including the South Cherokee WMA (Sept. 9-14).
 
  • Eliminate internet check-in of bears. TWRA is recommending this change to allow for better biological data collection and weight verification, and to improve the agency’s enforcement capabilities.
 
  • Require hunters to check-in big game animals on the calendar day that they are harvested. With the availability of internet check-in, the primary reason for establishing the 36-hour check-in period is obsolete. Requiring that big game animals be checked on the same calendar day as harvested will improve the agency’s law enforcement of big game check compliance.
 
  • The TWRA is recommending establishing quota hunt drawings for waterfowl hunts on Bogota WMA, Gooch WMA Unit E, and Thorny Cypress WMA. These quota drawings will provide quality waterfowl hunting opportunities for over 1,200 waterfowl hunters over the course of a 60-day duck season. The procedures for the quota drawings will be presented in a rule amendment.
 
In other items, the TWRC will vote on an amendment to the commercial use of wildlife. This amendment will affect live species that may be bought and sold in Tennessee, particularly crayfish and salamanders. The purpose of the amendment is to prevent the commercial sale of crayfish and salamanders obtained either by collection within the state or by those being purchased from outside the state. Sport anglers will still be allowed to collect and use crayfish and dusky salamanders for bait except from those areas identified in the Live Bait Proclamation.
 
The commission will hear a report on the Norris Lake Fisheries Advisory Committee. Results from the NLFA’s April 13 meeting will be discussed.
 
Dr. Mark Fly, Professor and Human Dimensions Research Lab Director with the Department of Forestry, Wildlife and Fisheries, UT Knoxville, will discuss the “Every Child Outdoors–Tennessee Coalition, Tennessee Children’s Outdoor Bill of Rights Resolution,”  recently signed by the Governor, and the upcoming Governor’s Summit on “Every Child Outdoors.”  TWRA is a joint presenter of the summit.
 
At the January commission meeting, the agency presented several proposals for new license types. The TWRA initiated the rule making process and the TWRC will take formal action to approve the following new license types: a one-day non-resident fishing license; a one-day non-resident trout fishing license; a one-day resident trout fishing license; and a seven-day & annual junior nonresident big-game licenses.

2010 Statewide Spring Turkey Season Opens April 3
NASHVILLE --- If the recently held young sportsman turkey hunt provides any indication, the forecast is good for Tennessee’s 2010 spring turkey season. The statewide season opens Saturday, April 3 and will continue through May 16.
Tennessee's young hunters harvested 1,285 birds across the state last weekend, a record for the two-day hunt. There were 1,066 turkeys harvested last year and the previous young sportsman hunt record was 1,191 set in 2007 before a damaging late season freeze and the ensuing summer drought. (more)

Application Period Underway for Second Elk Hunt
NASHVILLE --- The application period to participate in Tennessee’s second-ever managed elk hunt is now underway. The application period began at 8 a.m. (CDT) on Thursday, April 1 and will continue through May 31, 2010.
 
The second elk hunt will be held Oct. 18-22, 2010 at the North Cumberland Wildlife Management Area, located off I-75, north of Knoxville. Once again, there will be five Elk Hunting Zones designated at the WMA. (more)

By using or accessing this website (the "Site"), or by using any of the content hosting and sharing services provided via the Site ("Services"), you agree to be bound by these Terms of Service and by the Privacy Policy of Whitetail Domains LLC (" Whitetail Domains "), which are collectively referred to as the "Agreement." Please read the terms of this Agreement carefully. If you do not agree to the terms of this Agreement, then you may not use or access the Site or any of the Services of Whitetail Domains.

This Agreement sets forth the legally binding terms for your use of Whitetail Domains’s many individual Services. By using our Services, you agree to be bound by this Agreement, whether you are a "Visitor” or “Guest”, a Registered User (which means that you have registered with Whitetail Domains.com), or a fee-based "Member" of the site.

Users are only authorized to use the Services if you agree to abide by all applicable laws and to this Agreement. If you do not agree with all the terms contained herein, you should immediately terminate your use of Whitetail Domains.com and discontinue andy future use of its Services.

Whitetail Domains.com has the exclusive right to modify this Agreement as it feels necessary. Such modifications are in affect from the moment upon posting to the Whitetail Domains.com website. All Users alike are bound to any changes to this Agreement perpetually, regardless of specific revisions so long as they continue to utilize Whitetail Domains.com Services.

Whitetail Domains may, in its sole discretion, modify this Agreement from time to time, and may modify, suspend, or terminate the Site and Services, for any reason, and without notice. Although you may be asked to indicate your assent to the terms of this Agreement only once (e.g., when you register for a Whitetail Domains account), the terms of this Agreement, as modified by Whitetail Domains from time to time, will govern all use of the Site and Services. By continuing to use or access the Site or any of the Services, you agree to be bound by the Terms of Service in effect at the time of such use or access.

Description Of The Service

Whitetail Domains provides its Registered Users (defined below) with the ability to host a variety of content, including without limitation images and videos (including any audio accompanying the videos) ("Content") that Registered Users own or to which they have the necessary rights (" User Content "), in order to share User Content via the Web. Visitors, or “Guests” to the Site may view or share certain aspects of the User Content, but Guest Users are restricted via the website from viewing certain User Content or sharing certain User Content. Under the current terms of this Agreement, Guest and Registered Users will enjoy these Services free of charge. Members of Whitetail Domains are users of the system who pay a nominal fee for the ranch and/or lease management portion of the website. Members of Whitetail Domains have the highest level of services and access to the system and Members enjoy the ability to maintain a private website for their own ranch and/or lease and/or hunting club (“ Hunting Club ”). Members further enjoy a complete record management system for their Hunting Club and only current members of their own club may share User Content between and amongst other current members of the Hunting Club.

Although the Site and Services are normally available, there will be occasions when the Site or Services will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Whitetail Domains. Also, although Whitetail Domains will normally only delete Content that violates this Agreement, Whitetail Domains reserves the right to delete any Content for any reason, without prior notice. Deleted content may be stored by Whitetail Domains in order to comply with certain legal obligations and is not retrievable without a valid court order. Consequently, Whitetail Domains encourages you to maintain your own backup of your User Content. In other words, Whitetail Domains is not a backup service. As discussed further in this document, Whitetail Domains will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content.

Whitetail Domains.com has the exclusive right to modify this Agreement as it feels necessary. Such modifications are in affect from the moment upon posting to the WhitetailDomains.com website. Guest, Registered Users, and Members alike are bound to any changes to this Agreement perpetually, regardless of specific revisions so long as they continue to utilize WhitetailDomains.com Services.

Registered Users and Members should exercise caution when choosing what specific information to post on WhitetailDomains.com. Whitetail Domains does not permit the use of photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other Whitetail Domains.com Users may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services. WhitetailDomains.com assumes no responsibility or liability for this material whatsoever. If you become aware of the misuse of the Services by any person, please contact Whitetail Domains.com immediately.

WhitetailDomains.com reserves the right to reject, refuse to post or remove any posting by its Registered Users or Members, or to restrict, suspend, or terminate access to all or any part of its Services at any time, for any without prior notice, and without liability.

User Accounts And Passwords

Use of and Membership in the Services is void where prohibited. By using the Services, you represent and warrant that (i) all registration information you submit is truthful and accurate; (ii) you will maintain the accuracy of such information; (iii) your use of the Services does not violate any applicable law or regulation. Your account may be deleted and your utilization of the Site may be terminated without warning, if we believe that these guidelines are not upheld.

In order to access certain features of the Site and the Services, and to post Content, you must create a Whitetail Domains account. You may create an account on the Registration page. Once you have created an account, you will be a " Registered User ." Registered Users are limited to one free account per person. You may also upgrade to a "Member" account by paying a membership fee which enables your access to the ranch and/or lease and herd management system. Your Whitetail Domains account is solely for your own personal use and benefit. You are responsible for safeguarding the password that you use to access the Site and Services. You agree not to disclose your password to any third party nor to permit any third party to use your Whitetail Domains account. You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions. You will immediately notify Whitetail Domains of any unauthorized use of your password. In registering and creating an account, you agree to provide accurate, current and complete information, and to promptly update that information as necessary. Whitetail Domains will have no liability for failure to deliver notices that result from inaccurate account information.

At any time and at the sole discretion of Whitetail Domains, you may be limited to the file size, bandwidth, and storage limitations related to your account level. Whitetail Domains reserves the right , with prior written notice, to disable Users that are using excessive bandwidth or otherwise abusing the system. Whitetail Domains has the right to change its file size, bandwidth, or storage limitations without notice.

You acknowledge that Whitetail Domains reserves the right to charge for its Guest and Registered User Services and to change its fees from time to time for all User types at its discretion. If and when Whitetail Domains chooses to charge a fee for Guests or Registered Users, you will be so notified and bound to the terms herein. Failure to accept the terms of this agreement will result in the suspension of your account. Termination of your Membership because you have breached the Agreement, shall not be entitled to any applicable refund of any unused portion of applicable subscription fees.

This Agreement shall remain in full force and effect while you use the Services as a Guest or Registered User, or are a Member. Members of Whitetail Domains are billed annually in advance, and in the absence of your termination of your Membership status, your Membership will be renewed automatically each year on the anniversary date of your initial subscription date. You may terminate your Membership at any time, for any reason, by following the instructions on the Member Registration page. Termination becomes effective at the end of your then current annual subscription period, and Whitetail Domains is not obliged to refund any unused potion of your Membership fees. Whitetail Domains.com may terminate your Membership at any time, without warning and without liability.

Your License To Whitetail Domains

Whitetail Domains does not claim any ownership rights in any User Content that you choose to post to the Site. After posting User Content to the Site, you continue to retain all ownership or license rights in your User Content and you continue to have the right to use your User Content as you did prior to such posting. Further, Whitetail Domains will not disclose either on the Site or to any 3rd party any User data marked as “private”, nor will Whitetail Domains disclose any personal data about you, including you name, your ranch name (if marked as private), address, and other contact information (such as email addresses) to any 3rd party.

However, by posting or making User Content available through the Site or via the Services, you hereby grant to Whitetail Domains a nonexclusive, royalty-free, transferable, worldwide license to use, copy, modify, prepare derivative works from, distribute, publicly display and publicly perform (whether by means of a digital audio transmission or otherwise) and process your User Content, or any part of it, solely on and through the Site and Services, including without limitation (a) adapting the format of your User Content (for example by encoding or transcoding) for suitable display on the Site; and (b) displaying, in Whitetail Domains's sole discretion, your public User Content in search results generated by the Whitetail Domains search engine. In addition, where you have made your User Content public, posted a link to your User Content on another website or otherwise shared a link to your User Content, you grant to Whitetail Domains a nonexclusive, royalty-free, worldwide right to sublicense the right to copy, modify, prepare derivative works from, and distribute your User Content as necessary to perform the Services, including without limitation any services outsourced by Whitetail Domains. In connection with the above license, you provide your consent for Whitetail Domains personnel, including Whitetail Domains contractors and service providers, to view your User Content at any time for the purpose of providing the Services and filtering content that violates this Agreement. You acknowledge that you are solely responsible for all Content you submit to the Site or provide to the Service. You represent that you either own the User Content or have the rights necessary to grant Whitetail Domains this license.

Whitetail Domains's Limited License To You

Subject to your compliance with the terms and conditions of this Agreement, Whitetail Domains grants you a non-transferable, non-sublicensable right to access, view and print public Content, only for your personal, non-commercial use. With the exception of your User Content, you may not distribute any Content to third parties, use any Content commercially (except as may be permitted by a separate license explicitly attached to a particular piece of Content), or otherwise copy, modify, distribute, publicly display or perform any Content (except as such acts may be permitted by a separate license explicitly attached to such Content).

Restrictions

You will not do any of the following while using or accessing the Site or the Services:
  • Post, upload, email, or otherwise transmit (i) any Content that you do not have the lawful right to copy, transmit and display (including any Content that would violate any confidentiality or fiduciary obligations that you might have with respect to the Content); (ii) any Content for which you do not have the consent or permission of each identifiable person in the Content to use the name, voice, signature, photograph, or likeness of each such person (to the extent each is implicated by the Content); or (iii) any Content that infringes the intellectual property rights or violates the privacy rights of any third party (including without limitation copyright, trademark, patent, trade secret, or other intellectual property right, or moral right or right of publicity);
  • Delete, or in any manner alter, the copyright, trademark, or other proprietary rights notices appearing on any Content except your User Content;
  • Use any meta tags or other hidden text or metadata utilizing a Whitetail Domains name, trademark, URL or product name without Whitetail Domains's express written consent;
  • Post, upload, email or otherwise transmit, without first obtaining the permission of Whitetail Domains, any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, "pyramid schemes," Ponzi schemes or any other form of solicitation;
  • Post, upload, email, or otherwise transmit, via the Site or Services, any Content that is unlawful, obscene, harmful, threatening, harassing, defamatory, or hateful, or that contains objects or symbols of hate, invades the privacy of any third party, contains nudity or pornography (including without limitation any child pornography or child erotica), is deceptive, threatening, abusive, inciting to unlawful action, defamatory, libelous, vulgar or violent, or constitutes hate speech, or is otherwise objectionable in the opinion of Whitetail Domains;
  • Post, upload, email, or otherwise transmit any Content that contains software viruses or any other computer code, files, or programs designed to (i) interrupt, destroy, or limit the functionality of any computer software; or (ii) interfere with the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site;
  • Post, upload, email or otherwise transmit any Content that includes code that is hidden or otherwise surreptitiously contained within the images, audio or video of any Content that is unrelated to the immediate, aesthetic nature of the Content;
  • Attempt to probe, scan or test the vulnerability of any Whitetail Domains system or network or breach any security or authentication measures;
  • Forge any TCP/IP packet header or any part of the header information in any posting, or in any way use the Site or Services to send altered, deceptive, or false source-identifying information;
  • Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure protecting the Site or Services;
  • Collect or store personal data about other users without their express permission;
  • Impersonate or misrepresent your affiliation with any person or entity, through pretexting or any other form of social engineering, or otherwise commit fraud;
  • Resell the Services, in whole or in part;
  • Violate any applicable law, regulation, or ordinance; or
  • Use the Site or Services in any manner not permitted by this Agreement.


Whitetail Domains does not control the Content in Registered Users and Members accounts and does not have any obligation to monitor such Content for any purpose. However, on both free and Member accounts, and regardless of whether the Content is public or private, Whitetail Domains may choose to monitor such Content at any time, in its sole discretion. Whitetail Domains reserves the right at all times to terminate your account, and delete any and all Content, in whole or in part, for any reason including without limitation violations of this Section, or of any part of this Agreement. Whitetail Domains reserves the right at all times to disclose, in its sole discretion, any Content as necessary to (a) satisfy any law, regulation, or governmental request or (b) reduce or prevent what Whitetail Domains considers to be, in its sole discretion, a serious or imminent threat to your health or safety, or the health or safety of another. For information regarding Whitetail Domains handling of your personally identifiable information, refer to the Whitetail Domains Privacy Policy.

Age Requirements

Users of the Services must be at least 13 years of age. Children under the age of 13 are not permitted to use the Service and no information of children under the age of 13 will be knowingly collected by Whitetail Domains. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without the parent or guardian's consent by, for example, misrepresenting his or her age, that parent or guardian should contact us at the Contact Us page. If Whitetail Domains determines that it has collected personal information of children under the age of 13, Whitetail Domains will immediately delete such information and any accounts believed to be held by children under 13.

Disclaimer Of Warranty

THE SERVICES, CONTENT, SITE, AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WHITETAIL DOMAINS DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitations Of Liability

You understand that Content is posted by users and that Whitetail Domains has only limited control over the Content that is made available via the Site and Services. You understand that by using the Site and Services, you may be exposed to this Content. You acknowledge that Whitetail Domains will not be liable for
  • Content, including without limitation the subject matter of any Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use or download of any Content posted, emailed, transmitted, or otherwise made available via the Site or Services;
  • the deletion, failure to store, mis-delivery, or untimely delivery of any information or material; (c) Site unavailability or Service interruptions; or
  • the defamatory, offensive, or illegal conduct of any third party.


IN NO EVENT WILL WHITETAIL DOMAINS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF DATA, SERVICE INTERRUPTION, COMPUTER FAILURE, OR PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SITE OR ANY SERVICES, WHETHER BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR STRICT LIABILITY OR OTHER THEORY EVEN IF WHITETAIL DOMAINS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL WHITETAIL DOMAINS' AGGREGATE LIABILITY TO YOU OR TO ANY THIRD PARTY FOR ANY AND ALL CLAIMS ARISING OUT OF THE USE OF THE SITE OR ANY SERVICES EXCEED THE AMOUNTS YOU HAVE PAID TO WHITETAIL DOMAINS. You acknowledge that Whitetail Domains has set its prices and entered into this Agreement in reliance upon the limitations of liability specified herein, which allocate the risk between the parties and form a basis of the bargain between the parties. Some jurisdictions do not allow the exclusion or limitation of liability of incidental or consequential damages, so the above limitation may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Whitetail Domains and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or Services, or your violation of this Agreement. Whitetail Domains reserves the right, at its own expense, to assume the exclusive defense and control of any such claim otherwise subject to defense by you, in which event you will cooperate with Whitetail Domains and its counsel, as necessary, in the conduct of such defense.

The Site may contain links to third-party websites or resources. You acknowledge and agree that Whitetail Domains is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Whitetail Domains of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. Forum And Choice Of Law

This Agreement will be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this Agreement or your use of the Services will be filed only in the federal courts located in the State of Texas, or state courts located in Fort Bend County, Texas. You further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, or related to, use of the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose, or be forever barred. Disputes must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in Houston, Texas.

Refund Policy

Whitetail Domains will not honor any refunds for any paid Whitetail Domains services, including without limitation Member account payments, more than thirty (30) days after you last submitted such payment to Whitetail Domains. Should you find the need to request a refund, please email Customer Service or call us at 1-281-633-2334.

General

You may not assign any rights granted to you or delegate any of your duties hereunder; any attempt to do so is void and of no effect. Whitetail Domains may assign its rights and delegate its duties under this Agreement in their entirety in connection with a merger, reorganization or sale of all, or substantially all, of its assets relating to this Agreement. The failure of Whitetail Domains at any time to require performance of any provision hereof shall in no manner affect its right at a later time to enforce the same unless the same is waived in writing. If a court should find that one or more rights or provisions contained in this Agreement are invalid, you agree that the remainder of the Agreement will be enforceable. The headings and captions are for convenience only and are not to be used in the interpretation of this Agreement. This Agreement constitutes the complete and exclusive understanding and agreement between you and Whitetail Domains regarding its subject matter, and supersedes all prior and contemporaneous agreements or understandings relating to such subject matter.
